A recent case in East Sussex
Earlier this week East Sussex Fire and Rescue Services (ESFRS) secured the prosecution of a HMO operator. Fire Safety inspection officers visited the property in Feb 2023, responding to tips about the storage of fireworks in a ground floor commercial unit. They made some incredible discoveries when inspecting the HMO above, finding significant fire safety failings such as faults with the fire alarm system, issues with smoke detectors, removal of a fire door, and issues with self-closers on another fire door. Most alarmingly, escape routes were not secure, actually being used to store combustible materials.
Ultimately, ESFRS gave the RP informal advice to make improvements and do a fire risk assessment. They then followed up with formal enforcement notices and additional inspections to see if there was any progress. Sadly, remedial work was not complete until early in 2024. ESFRS chose to prosecute because it took so long for action, ignoring the serious risk to tenants.
The case ended with the RP pleading guilty at Brighton Magistrates’ Court. The Court issued a £3,875 fine, as well as an order to pay £7,075.31 to cover ESFRS costs. This is a key reminder of how important it is to think about fire safety, responsibilities, and complying with any notices. Plus, it reiterates that FRAs are fundamental.
